The Job-Site Serial List Is Not the Package

Construction fleets mobilize fast and attachment lists diverge faster, so lenders need § 9-105 control and TOLEC transfers so rent-to-own conversions do not rebuild dealer files. Filing under § 9-310 may perfect some interests; it does not replace control of the electronic original.

Your dealers, rental fleets, and contractors move titled machines and attachments across job sites. Serial lists that drift from what credit booked turn a rent-to-own conversion into an argument about what was financed. Yellow iron on an American site is chattel. The contractor should be able to collateralize it, and the lender should be able to prove control, without a second original on a superintendent’s phone.

Section 9-330 rewards purchasers who can show possession or control of the paper. Job-site email is not that showing. Run a chattel check against vault state before the iron mobilizes.

Mobilize the Iron, Not a Second Original

Lock machine identity, attachments, and filings to one authoritative package before iron leaves the yard. Contractor tasks belong on the live record. Job-site changes append as versions. They must not mint a forwardable original outside the vault.

A § 9-310 filing may perfect some interests. Electronic originals still need § 9-105 control if takeout assignment is supposed to be clean. Default UCC9 compliant custody, then TOLEC into the takeout vault on the real time transfer network (RTTN), is how rent-to-own converts without rebuilding dealer files. You can prove who holds the original after conversion.

  • Do not fund until vault readiness, and do not mobilize before that gate
  • Version attachment changes on the funded package identity
  • Pass rent-to-own and secondary sales vault lineage via TOLEC

Ask Before Mobilization

  1. Are attachments and serials on the same package you funded?
  2. Can rent-to-own convert without rebuilding dealer files?
  3. Does the secondary buyer see the same custody events your operations team already trusts?
