Spring Advance, Fall Takeout: Harvest Does Not Waive the Original

Ag equipment and livestock facilities change with the season; UCC § 9-334 fixture and crop priority and § 9-105 control do not. Kansas § 84-9-105 states the control test, and captives need vault custody through spring advances and harvest takeouts—including when Texas manufactured-housing titling flips.

Your captives, banks, and co-ops fund titled equipment, livestock schedules, and seasonal facilities. The mix changes between planting and harvest. The need for one electronic original does not. A combine, a herd, a grain facility—if it has value, the operator should control that chattel and be able to collateralize it when the season turns.

Section 9-334’s fixture and crop priority rules are the reminder that ag packages sit on the line between goods, fixtures, and growing crops. Inspection evidence and dealer files that leave the funded package turn spring advances and fall takeouts into rebuilds. Farm credit stays unreliable when the chain of custody is a box in the farm file.

Seasonality Is Not a Custody Exception

Dealer and co-op origination should post into controlled packages before any advance. Inspections and borrower tasks belong on the live record. Warehouse takeouts should inherit TOLEC lineage on the real time transfer network (RTTN) even when harvest pressure is on. Farm-file archaeology is not a seasonal exception. You can prove who holds the original at takeout. The warehouse does not rebuild dealer files under harvest pressure.

Manufactured or mobile housing next to ag real estate often follows Texas TDHCA practice: titling can flip between personal and real property depending on facts and filings. Keep the electronic payment obligations under § 9-105 control on either side of that fork.

  • Do not fund until the vault is ready, including at peak season
  • Brand inspections and borrower tasks update the booked package
  • Takeouts leave the seller a watermarked copy and the buyer the original

Ask Before the Advance and the Takeout

  1. Is there one authoritative package for the equipment and livestock obligations you fund?
  2. Do inspections update the same controlled record credit booked?
  3. Can the warehouse takeout inherit custody without rebuilding dealer files?
